FIXNOW – TERMS AND CONDITIONS

1. Introduction
These Terms and Conditions ("Terms") govern your use of the FixNow platform, including the FixNow mobile application and website. By accessing or using FixNow, you agree to be bound by these Terms. These Terms apply to both customers and tradespeople.
2. About FixNow
FixNow is a digital marketplace that connects customers with independent tradespeople who provide real-world home and property services. FixNow does not provide trade services and is not a contractor, employer, or agent of any user.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use FixNow. By using FixNow, you confirm that you meet these requirements.
4. Role of FixNow
FixNow acts solely as a technology platform. Any agreement for services is made directly between customers and tradespeople. FixNow is not a party to such agreements.
5. Property Damage & Personal Injury
Nothing in these Terms excludes or limits liability where it would be unlawful to do so. FixNow is not responsible for the acts, omissions, or conduct of tradespeople or customers, including any property damage, personal injury, or loss arising from services arranged through the platform.
6. Tradespeople Status
All tradespeople are independent contractors and are solely responsible for their services, qualifications, insurance, taxes, and legal compliance.
7. Bookings & Payments
Any payments made through FixNow relate solely to real-world services provided by tradespeople. FixNow is not responsible for pricing disputes, cancellations, refunds, or service outcomes between users. Payments are processed securely by a third-party payment provider. FixNow may charge a service fee for use of the platform. Tradespeople are responsible for providing services, setting prices, and handling refunds or disputes where applicable. FixNow does not provide trade services and is not responsible for service outcomes between users.
8. User Conduct
Users must not misuse the platform, provide false information, engage in fraud, harassment, unlawful behaviour, or attempt to circumvent FixNow systems.
9. Disputes
Disputes between users must be resolved directly between the parties. FixNow may assist with dispute resolution at its discretion but has no obligation to do so.
10. Limitation of Liability
To the fullest extent permitted by law, FixNow’s total liability is limited to £100 or the amount paid to FixNow by the user in the previous 12 months, whichever is greater, except where liability cannot be limited by law.
11. Governing Law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
